1. Introduction

These Terms and Conditions ("Terms") govern your use of the TutorKamun website and online tutoring platform (together, the "Platform"), operated by TutorKamun Ltd, a company registered in England and Wales (Company No. [XXXXXXXX]), with a registered address at [Registered Address] ("we", "us", "our").

By registering for an account or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

If you are registering on behalf of a child under the age of 18, you (as the parent or guardian) agree to these Terms on the child's behalf and accept responsibility for their use of the Platform.

2. Definitions

In these Terms, the following words have the meanings set out below:

3. Eligibility

3.1 Students and Parents/Guardians

  • You must be at least 18 years old to create an account in your own name.
  • If you are under 18, a parent or guardian must register the account and agree to these Terms on your behalf.
  • By creating an account, you confirm that the information you provide is accurate and complete.

3.2 Tutors

To register as a Tutor, you must:

  • Be at least 18 years of age
  • Hold the right to work in the United Kingdom
  • Provide accurate information about your qualifications and experience
  • Consent to and pass an Enhanced Disclosure and Barring Service (DBS) check before tutoring begins
  • Maintain a valid DBS certificate at all times while active on the Platform

We reserve the right to refuse or revoke Tutor registration at our sole discretion.

4. Account Registration and Security

  • You must provide accurate, current, and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
  • You must notify us immediately at security@tutorkamun.com if you suspect any unauthorised access to your account.
  • You may not share your account with another person or create multiple accounts.
  • We reserve the right to suspend or terminate accounts that we believe have been created fraudulently or are being misused.

5. Platform Services

5.1 What We Provide

We provide an online marketplace and communication platform that connects Students (and their Parents/Guardians) with Tutors. We facilitate the booking, scheduling, payment, and delivery of one-to-one or small-group tutoring sessions.

5.2 What We Do Not Provide

  • We are a technology platform, not a tutoring agency. Tutors are independent contractors, not employees of TutorKamun Ltd.
  • We do not guarantee the academic outcomes or results of any tutoring sessions.
  • We do not guarantee the continuous availability of any specific Tutor.

5.3 Platform Availability

We aim to make the Platform available 24 hours a day, 7 days a week. However, we do not guarantee uninterrupted access and may suspend the Platform for maintenance, updates, or reasons beyond our control. We will endeavour to give reasonable advance notice of planned downtime.

6. Booking and Cancellation

6.1 Booking Sessions

  • Sessions must be booked through the Platform. Off-platform bookings are not permitted.
  • A booking is confirmed once payment has been successfully processed.
  • You will receive a booking confirmation by email.

6.2 Cancellation by Students/Parents

  • Cancellations made more than 24 hours before the scheduled session start time will receive a full refund or session credit.
  • Cancellations made within 24 hours of the session will not be refunded, except at the Tutor's discretion.
  • No-shows (failing to attend without cancellation) will be charged in full.

6.3 Cancellation by Tutors

  • Tutors must give at least 24 hours' notice if they need to cancel a session.
  • If a Tutor cancels with less than 24 hours' notice, the Student will receive a full refund or session credit.
  • Repeated short-notice cancellations by a Tutor may result in suspension or removal from the Platform.

6.4 Rescheduling

Sessions may be rescheduled by mutual agreement between the Student/Parent and Tutor, using the Platform's messaging and scheduling tools.

7. Fees and Payment

7.1 Pricing

Tutoring session fees are displayed on each Tutor's profile. Fees may vary between Tutors and subject areas. All prices are shown in pounds sterling (GBP) and are inclusive of VAT where applicable.

7.2 Payment Processing

  • Payments are processed securely via our third-party payment provider (e.g., Stripe). By making a payment, you also agree to that provider's terms of service.
  • We do not store your full card details.
  • Payment is taken at the time of booking.

7.3 Tutor Payments

  • Tutors will receive payment for completed sessions, less our platform commission, as set out in the Tutor Agreement.
  • Payments to Tutors are made on a [weekly/fortnightly] basis to the bank account registered on their profile.

7.4 Refunds

Refunds will be issued in accordance with Section 6 (Cancellation) or where we determine, at our sole discretion, that a refund is appropriate (for example, in the event of a technical failure preventing a session from taking place). Refunds will be made to the original payment method within 5–10 business days.

8. Consumer Rights — Right to Cancel

If you are a consumer (i.e., an individual booking a session for personal, not business, purposes), you have the right to cancel your contract within 14 days of booking without giving any reason (the "Cooling-off Period") under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

However, if you request that the service begins within the 14-day Cooling-off Period and then cancel, we may deduct the value of any sessions that have already taken place from your refund.

9. Conduct and Community Standards

All users of the Platform — Students, Parents/Guardians, and Tutors alike — must comply with the following standards:

9.1 You Must Not:

  • Use the Platform for any unlawful purpose
  • Harass, abuse, threaten, or discriminate against any other user
  • Share false, misleading, or defamatory information
  • Attempt to circumvent our platform by arranging off-platform sessions with Tutors or Students you have met through the Platform (see Section 10)
  • Upload or share any content that is offensive, obscene, or infringes the rights of others
  • Attempt to hack, disrupt, or reverse-engineer any part of the Platform
  • Impersonate any person or organisation

9.2 Children's Safety

  • Tutors must never contact Students outside of the Platform's messaging system.
  • Any behaviour that causes concern for a child's safety must be reported immediately to safeguarding@tutorkamun.com.
  • We reserve the right to report safeguarding concerns to the appropriate authorities without prior notice.

Breach of these standards may result in immediate suspension or permanent removal from the Platform, and may be reported to the police or other relevant authorities where appropriate.

10. Off-Platform Arrangements

To protect the safety and interests of all users, you agree that:

  • You will not arrange or conduct tutoring sessions with any Tutor or Student you have connected with through TutorKamun outside of the Platform, for a period of 12 months after your last interaction on the Platform.
  • You will not solicit or accept contact details from another user for the purpose of bypassing the Platform.

Breach of this clause may result in account termination and we reserve the right to pursue compensation for lost platform fees.

11. Intellectual Property

11.1 Our Content

All content on the Platform — including the website design, software, text, logos, and branding — is owned by or licensed to TutorKamun Ltd and is protected by UK and international intellectual property laws. You may not copy, reproduce, or distribute any part of it without our prior written consent.

11.2 User Content

  • You retain ownership of any Content you upload or share on the Platform (such as lesson notes or materials).
  • By uploading Content, you grant us a non-exclusive, royalty-free licence to use, store, and display that Content for the purposes of operating the Platform.
  • You must ensure that any Content you upload does not infringe the intellectual property rights of any third party.

11.3 Session Recordings

Where sessions are recorded (where this feature is available and both parties have consented), recordings are for personal educational use only. Recordings must not be shared publicly or used for commercial purposes without the written consent of all parties.

12. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for any indirect, consequential, or special losses arising from your use of the Platform, including (but not limited to) loss of earnings, loss of educational opportunity, or loss of data.
  • Our total liability to you in connection with these Terms, whether in contract, tort (including negligence), or otherwise, shall not exceed the total amount paid by you to us in the 3 months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; any liability that cannot be excluded or limited under applicable law (including the Consumer Rights Act 2015 and the Unfair Contract Terms Act 1977).

13. Disclaimer of Warranties

The Platform is provided "as is" and "as available". We make no warranties, express or implied, that the Platform will meet your requirements, be uninterrupted, error-free, or free from viruses or other harmful components.

We do not guarantee that any Tutor is appropriately qualified for your specific needs, though we take reasonable steps to verify qualifications and conduct DBS checks.

14. Third-Party Links and Services

The Platform may contain links to third-party websites or integrate with third-party services (such as payment processors or video conferencing tools). We are not responsible for the content, privacy practices, or terms of any third-party services. Your use of such services is at your own risk and subject to their own terms.

15. Suspension and Termination

15.1 By You

You may close your account at any time by contacting us at hello@tutorkamun.com. Any pre-paid session credits that remain unused at the time of closure will be refunded.

15.2 By Us

We may suspend or terminate your account, with or without notice, if:

  • You breach these Terms
  • We have reason to believe your account is being used fraudulently or in a manner harmful to others
  • We are required to do so by law or a regulatory authority
  • We cease operating the Platform

Upon termination, your right to use the Platform will end immediately. Clauses that by their nature should survive termination (including Sections 10, 11, 12, and 16) will continue to apply.

16. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of England and Wales.

Any disputes arising from these Terms or your use of the Platform will be subject to the exclusive jurisdiction of the courts of England and Wales.

If you have a complaint, please contact us first at hello@tutorkamun.com. We aim to resolve complaints within 14 working days. If we cannot resolve your complaint, you may be eligible to refer it to an alternative dispute resolution (ADR) scheme — details available on request.

17. Changes to These Terms

We may update these Terms from time to time. Where we make material changes, we will notify you by email or via a prominent notice on the Platform at least 14 days before the changes take effect.

Your continued use of the Platform after that date constitutes acceptance of the revised Terms. If you do not agree to the changes, you should stop using the Platform and close your account before they take effect.

18. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be deemed severable from these Terms and will not affect the validity and enforceability of the remaining provisions.

19. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and us in relation to your use of the Platform and supersede any prior agreements or representations.
